2. Leistungsbeschreibung
Manifest bietet einen strukturierten Projektdiagnosedienst an. Der Kunde füllt einen Fragebogen mit 12 Fragen aus und erhält einen personalisierten PDF-Diagnosebericht, der menschliche und organisatorische Risikosignale im Projekt analysiert.
Der Diagnosebericht ist ein analytisches Hilfsmittel. Er ersetzt keine professionelle Unternehmensberatung und enthält keine Garantien bezüglich des Projekterfolgs. Die Bewertungen und Empfehlungen im Bericht basieren auf den vom Kunden bereitgestellten Informationen.
3. Vertragsschluss
Der Vertrag kommt zustande, wenn der Kunde Manifest per E-Mail kontaktiert, den Auftrag bestätigt und die Zahlung per Banküberweisung eingeht. Nach Zahlungseingang wird der Fragebogen-Link übermittelt.
4. Preise und Zahlung
Der Preis für den Diagnosebericht beträgt 50,00 EUR. Die Zahlung erfolgt ausschließlich per Banküberweisung. Bankdaten werden nach Auftragsbestätigung per E-Mail mitgeteilt.
Da Manifest unter die Kleinunternehmerregelung gemäß §19 UStG fällt, wird keine Umsatzsteuer berechnet.
5. Lieferung
Der Diagnosebericht wird nach Eingang des ausgefüllten Fragebogens so schnell wie möglich, spätestens jedoch innerhalb von 5 Werktagen, per E-Mail als PDF-Datei zugestellt.
6. Widerrufsrecht und Rückerstattung
Da es sich um eine digitale Dienstleistung handelt, die nach vollständiger Erbringung (Zustellung des Berichts) keinen Anspruch auf Widerruf mehr begründet, ist nach Lieferung des Berichts keine Rückerstattung möglich.
Bei technischen Fehlern oder Nichtlieferung innerhalb der genannten Frist wird der Betrag vollständig erstattet.
7. Haftungsbeschränkung
Der Diagnosebericht basiert ausschließlich auf den vom Kunden bereitgestellten Informationen. Manifest übernimmt keine Haftung für Entscheidungen, die auf Basis des Berichts getroffen werden. Die Haftung ist auf den Betrag der geleisteten Zahlung begrenzt.
8. Vertraulichkeit
Alle im Rahmen des Dienstes ausgetauschten Informationen werden vertraulich behandelt und nicht an Dritte weitergegeben.
9. Anwendbares Recht
Es gilt deutsches Recht. Gerichtsstand ist, soweit gesetzlich zulässig, der Wohnsitz des Anbieters.

2. Service Description
Manifest provides a structured project diagnostic service. The client completes a 12-question questionnaire and receives a personalised PDF diagnostic report analysing human and organisational risk signals within the project.
The diagnostic report is an analytical support tool. It does not replace professional management consulting and contains no guarantees regarding project success. Assessments and recommendations in the report are based on information provided by the client.
3. Contract Formation
The contract is formed when the client contacts Manifest by email, confirms the order, and payment by bank transfer is received. Upon receipt of payment, the questionnaire link will be provided.
4. Pricing and Payment
The price for the diagnostic report is €50.00. Payment is made exclusively by bank transfer. Bank details will be provided by email after order confirmation.
As Manifest operates under the German small business regulation (§19 UStG), no VAT is charged.
5. Delivery
The diagnostic report will be delivered by email as a PDF file as soon as possible, and no later than 5 working days after receipt of the completed questionnaire.
6. Cancellation and Refunds
As this is a digital service, no refund is possible once the report has been delivered. In the event of technical failure or non-delivery within the stated timeframe, the full amount will be refunded.
7. Limitation of Liability
The diagnostic report is based solely on information provided by the client. Manifest accepts no liability for decisions made on the basis of the report. Liability is limited to the amount of the payment made.
8. Confidentiality
All information exchanged as part of the service is treated as confidential and will not be shared with third parties.
9. Governing Law
These terms are governed by German law. The place of jurisdiction is, to the extent permitted by law, the registered address of the provider.

2. Descrizione del servizio
Manifest fornisce un servizio di diagnostica strutturata di progetto. Il cliente compila un questionario di 12 domande e riceve un report diagnostico PDF personalizzato che analizza i segnali di rischio umani e organizzativi nel progetto.
Il report diagnostico è uno strumento di supporto analitico. Non sostituisce una consulenza manageriale professionale e non contiene garanzie riguardo al successo del progetto. Le valutazioni e le raccomandazioni nel report si basano sulle informazioni fornite dal cliente.
3. Conclusione del contratto
Il contratto si conclude quando il cliente contatta Manifest via email, conferma l'ordine e il pagamento tramite bonifico bancario viene ricevuto. Al ricevimento del pagamento verrà fornito il link al questionario.
4. Prezzi e pagamento
Il prezzo per il report diagnostico è di 50,00 EUR. Il pagamento avviene esclusivamente tramite bonifico bancario. Le coordinate bancarie verranno comunicate via email dopo la conferma dell'ordine.
Poiché Manifest opera in regime di franchigia IVA ai sensi del §19 UStG tedesco, non viene addebitata IVA.
5. Consegna
Il report diagnostico verrà consegnato via email come file PDF nel più breve tempo possibile, e comunque entro 5 giorni lavorativi dal ricevimento del questionario compilato.
6. Recesso e rimborsi
Trattandosi di un servizio digitale, non è possibile alcun rimborso una volta che il report è stato consegnato. In caso di malfunzionamento tecnico o mancata consegna entro i termini indicati, l'intero importo verrà rimborsato.
7. Limitazione di responsabilità
Il report diagnostico si basa esclusivamente sulle informazioni fornite dal cliente. Manifest non si assume alcuna responsabilità per le decisioni prese sulla base del report. La responsabilità è limitata all'importo del pagamento effettuato.
8. Riservatezza
Tutte le informazioni scambiate nell'ambito del servizio sono trattate come riservate e non vengono condivise con terzi.
9. Legge applicabile
Si applica il diritto tedesco. Il foro competente è, nei limiti consentiti dalla legge, il domicilio del fornitore.
